Overview

Students will be able to understand and resolve the main legal issues related to the management of individual employment relationships and the interpretation of the given regulation and agreement, with particular reference to the different stages of recruitment, the performance and extinction ratio work, examining and coordinating, to that end, the various sources of regulatory, legal, contractual and jurisprudence. After completing the course and after passing the exam, the student will then be able to apply their knowledge independently of the evolution of matter.

Admission requirements

While prerequisites are no longer required by the Department, understanding the notions, concepts and principles of the Labor Law requires adequate knowledge of the notions imparted in the basic teachings of Constitutional Law, Institutions of Private Law I and Institutions of Roman law

Course contents

The course of labor law examines in detail legislation and collective bargaining in regard to the performance of employment in private enterprise and public administration, with regard to all its phases, from recruitment to development of the relationship, and finally extinction. The focus is not only to the employment relationship but also to the types of quasi-subordinate work and self.

Teaching methods

The lessons will be carried out in presence or remotely synchronously (streaming), with the involvement of those present, and / or asynchronously (recorded) due to the health situation COVID19. students will be promptly updated. In presence or remote tests, including written ones, will be provided to verify the skills acquired by the students after mid-course During the lessons are projected slide illustrative and depth and through internet, students are allowed to deepen the individual issues and know the guidelines of the law, collective bargaining, instructions (circulars, messages, may approach) of the Ministry of Labour and agencies social security (INPS and INAIL), the legislation in the pipeline, the debates and the interventions of the doctrine and experts. Will also be undertaken, periodically, the analysis of the case law in order to better explain the practical applications of rules learned in class. During the academic year students have the opportunity to participate in seminars on current issues of particular interest. The contents of education are coordinated between the different teachings related to the same SSD IUS07. In particular, the course of labor law is coordinated with three teachings: Trade Union Law, Social Security Law, Active policies and equal opportunities in public and private work.

Assessment methods

The Assessment will be by oral exam, which generally consists of three / four questions and that traditionally has been revealed as a mode suitable for the preparation and verification of the Knowledge of the topics covered, the ability to deepen and critical reasoning, the ability to apply and connect the acquired knowledge, the ability to argue, the mastery of technical-legal language. Will however possible written tests in progress with closed questions and / or open, in order to verify the level of student ability in dealing with a written text and mastery of the legal lexicon and that specific in the areas of employment law.The tests could be carried out in the presence or at a distance depending on the evolution of the COVID19 situation.

Learning outcomes

Through lectures and written tests, students will learn the basics of labor law and the right to organize Italian, as well as the specific vocabulary, and will then be able to apply their knowledge in order to solve, while maintaining its independence, the main legal issues related to the subject matter, moving independently between different legal sources, contractual, administrative, especially in light of the practical application of the Ministry of labor and social security funds and the interpretation.

Overview

Students will be able to understand and resolve the main legal issues related to management of individual employment relationships and interpretation of the collective agreements, with reference to the different stages of employment, the performance and ending of the job relationship, the sources of Labour Law. After completing the course and after passing the exam, students will be able to apply their knowledge independently from the evolution of the topic.

Admission requirements

There aren't pre-requisites; anyway, the ownership of basic notions of private and public law is appreciated.

Course contents

The course of Labour Law examines in details the statutory and collective regulation of employment in private enterprise and public administration. It relates to all the phases of the job relationship, from the beginning to the development and the extinction. The course is focused not only to the employment relationship but also to the types of quasi-subordinate and autonomous work.

Teaching methods

Frontal lessons, with possible involvement of the students, and possible audits "in progress" (also written) to verify the acquisition of skills by the students. Through some slides and the use of the Internet, it will be possible to examine the main law texts and the collective agreements, the debate within scholars and Courts. It will also be undertaken the case analysis in order to explain the practical applications of rules. During the academic year students have the opportunity to attend seminars on current issues. The course of Labour Law will be coordinated with the courses of Trade Union Law and Social Security Law, Anyway, the basic notions of Collective bargaining, trade union law and rights, strike will be granted within the course of Labour Law. The course will be offered face-to-face in the First Semester 2021-2022, unless different indication by the authorities related to the evolution of the Covid- 19 pandemic

Assessment methods

The Assessment will be in oral form, and consist of three / four questions: traditionally it has been revealed as a mode suitable for the preparation and verification of the students' ability and come to correct solutions. It will however be possible to have written tests in progress with closed questions and / or open ones, in order to verify the level of student ability in dealing with a written text and the legal lexicon specifically in the area of employment law. Exams of the a.y. 2020/2012 will take place either on campus or on line depending on the evolution of the Covid-19 situation

Learning outcomes

Knowledge and understanding - learning skills: through lectures and written tests, students will learn the basic Labour law, as well as the specific vocabulary.
Applying knowledge and understanding: students will be able to apply their knowledge in order to solve the main legal issues related to the matter.
Making judgements - Communication skills: students will be able to move autonomously between different legal and judiciary, contractual and administrative sources.
