Overview

The course aims to provide a critical overview of Italian and European legal history from the Middle Ages to the Modern Age. The teaching methods used to present the topics intend to stimulate the student's critical thinking, his sense of historical continuity and his understanding of the social foundations and of the cultural and economic aspects of legal phenomena.

Admission requirements

The knowledge of the main institutions of Roman law is useful.

Course contents

For all the students
1. The legal culture of the early medieval age
II. The low-medieval age and the ius commune
III. The start of the modern age
IV. The legal culture of the ancien régime
V. Natural law, Enlightenment, codification
VI. Constitutional systems
VII. The legal culture of the nineteenth century and the civil code
VIII. The twentieth century in Italy: Fascism and democracy

Teaching methods

The course is offered in the Second Semester either on line or on campus depending on the evolution of the COVID-19 situation. In any case, in the Academic Year 2020-2021, lessons will be available also on line. The learning will be supported by the study of the reference texts mentioned in the program, for the better understanding of which is highly recommended frequency of the lessons of the teacher. The lessons do not exclude moments of discussion and debate, both in the lesson, both in meetings from time to time scheduled, even at the request of students.

Assessment methods

Exams will take place either on campus or on line depending on the evolution of the Covid-19 situation The oral examination will be done in a single final exam. The examination will consist of at least three questions and will last 20 minuti approximately

Learning outcomes

1. A good knowledge of the issues addressed to in the reference texts and during lessons.
2. The ability to connect the issues to the relevant socio-historical dynamics that leads to the understanding of legal phenomena.
3. Critical understanding of the issues, coupled with a certain degree of independent judgment.
4. Command of the Italian language, clarity, consistency.
5. Historical and comparative contextualization skill, necessary for a proper learning of the law in force.
